1. All BC Services must be used for legal purposes. 2. No unsolicited mailings or SPAM(TM) is allowed. We actively monitor all aspects of our system and will notice the mail increases that these types of offenses usually produce. 3. Invoicing is done through email. If you want a paper copy of your invoice sent to you, a charge will apply. 4. If you are paying by credit card you authorize BC Publishing to apply charges to your credit card on a monthly basis. These charges will be for the services rendered. 5. If your credit card is declined we will email you the decline and ask for another method of payment. If you do not respond within 5 (five) Business Days (Monday-Friday) with another form of payment, then your service will be terminated. Only exception is if other arrangements have been made with our billing department. 6. Payment by check must be in our offices no later than 3 (three) days after the due date. If payment is not received we will notify you by your billing email address and you will have 5 (five) Business Days (Monday-Friday) to respond with another form o f payment or arrangements. Failure to do so will be grounds for termination of the account. Note* Overseas checks must be payable in United States Funds. 7. Failure to pay in no way relieves the client's obligations to make full payment. Client hereby agrees to pay any and all attorney fees, court costs, and related expenses incurred by BC Publishing in the collection of any amount due to BC Publishing. 8. New accounts who pay by check must have the check in our offices 15 (fifteen) days after the account is first created. We will stop service for any account not paid for after service is setup. Note* Setup does not include domain name setup as it may ta ke the Internic a while to setup your domain name. 9. We reserve the right to change the price for our services at any time. We will announce price changes to existing accounts and those changes will not be charged until thirty days after the announcement. Changes are effective immediately for any new accounts created the day after the announcement. 10. Until you cancel your account you will be responsible for all charges applied to your account. No further services or charges will be applied to your account after cancellation is received. We would prefer that we have some advanced notice of your cancellation, but we realize that sometimes conditions arise and service must be terminated immediately. Service will be pro-rated if needed for that current month's service. Because of discounts g iven for payment of "advance payment accounts", no refunds will be given and service will remain available during the "advance" period. 11. A re-activation fee will be charged for any account that needs to be re-activated because of termination due to non payment. Reactivation fee is 1/2 of your current total due. 12. We reserve the right to refuse service to anyone at anytime. We will always provide reasonable time for you to move your information if the situation arises. 13. THE PROVIDER SERVICE IS PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS. THE PROVIDER GIVES NO WARRANTY, EXPRESSED OR IMPLIED, FOR THE VIRTUAL/NON-VIRTUAL SERVER SERVICES PROVIDED, INCLUDING, WITHOUT LIMITATION, WARRANTY OF MERCHANTABILITY AND WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. THIS NO WARRANTY EXPRESSLY INCLUDES ANY REIMBURSEMENT FOR LOSSES OF INCOME DUE TO DISRUPTION OF SERVICE BY PROVIDER OR ITS PROVIDERS BEYOND THE FEES PAID BY CLIENT TO PROVIDER FOR SERVICES. 14. BC Publishing will make every reasonable effort to protect and backup data for the client on a regular basis. However, BC Publishing is not responsible for Client's files unless a backup plan has been purchased. We are still pricing these services at this time and would like to make our intentions known today. If your data is mission critical, please consider a backup plan. Please email for proposed pricing of backup plans. We currently back your data up weekly just for redundancy. 15. BC Publishing maintains control and ownership of all IP numbers that may be assigned to you and we may also change them at anytime as needed for network changes. 16. BC Publishing will maintain its network in a proper running order. Since events do "happen", BC Publishing will agree to a pro-rated refund schedule for loss of service over a 24hr. period. Loss of service is defined as services under BC Publishing's control that are not serviced as claimed in the agreement. 17. You will notify BC Publishing in the event that the security of your account has been compromised. If you do not notify us of such misuse, you will be held accountable for the misuse. 18. You consent to the jurisdiction of court within the county of Franklin, state of Ohio, in the United States for any action arising from this transaction.
